These Terms of Use (“Terms”) govern your access to and use of the ImmerseMe website and the ImmerseMe virtual reality (VR) platform, including VR experiences accessed through our physical VR headsets (collectively, the “Services”). The Services are owned and operated by Jasoren LLC (“ImmerseMe”, “we”, “us”, or “our”). By accessing our website or using our VR platform, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.

ImmerseMe provides location-based virtual reality experiences through physical VR headsets installed at designated VR stations. We also operate an informational website that describes our services and displays embedded media content. The website does not offer e-commerce functionality, account registration, or interactive user features.

By using the Services, you confirm that you are legally permitted to do so under applicable laws. Minors under the age of majority in their jurisdiction may only use the VR platform with the permission and direct supervision of a parent or legal guardian, and any such use is deemed to occur with the consent of the guardian. By completing a payment to unlock a VR session or by entering a voucher code, the owner of the payment method or the person providing the voucher explicitly confirms that they are the parent or lawful guardian of the user, grant full consent for the minor to participate, and agree to assume all physical, medical, and financial liabilities associated with such use.

The ImmerseMe website is provided solely for informational purposes. You may browse, view, and read content for personal, non-commercial use only. You agree not to use the website for any unlawful purpose, not to attempt to interfere with its operation or security, and not to copy, reproduce, distribute, or exploit website content for commercial purposes without our prior written consent.

ImmerseMe offers both unlocked headsets for free VR sessions and locked headsets that require payment or a valid voucher to unlock and access VR sessions. For pay-per-use sessions, users must scan a QR code displayed on the headset and complete the payment process through a third-party payment provider or enter an authorized promotional/prepaid voucher code. Access to the VR experience is granted only after successful payment or voucher confirmation.

You agree to use all VR equipment responsibly and in accordance with any instructions, safety guidelines, or warnings displayed on the headset, at the VR station, or otherwise provided by ImmerseMe. You must follow all reasonable instructions from ImmerseMe staff if applicable and respect the comfort, safety, and experience of others using the Services. You must immediately stop using a VR experience if you experience discomfort, dizziness, nausea, or pain.

You must not use the Services while under the influence of alcohol, drugs, or any substance that impairs your ability to safely participate. You are responsible for any damage caused to our equipment due to misuse, negligence, or failure to follow instructions.

Physical Environment Safety and User Conduct. You acknowledge and agree that the VR headset completely blocks your natural vision and hearing. Before starting the session, you are strictly required to sit in the provided seating or remain within the designated, marked VR station safety zone. You explicitly agree that ImmerseMe (Jasoren LLC) shall not be liable for any personal injury, property damage, or third-party incidents arising from your movement outside the designated safety area, loss of balance, or collisions with venue furniture, staff, or other patrons. You use the device in a public space entirely at your own risk.

Equipment Ownership, Maintenance, and Venue Responsibility. ImmerseMe (Jasoren LLC) provides the software platform and technology infrastructure. Physical VR stations and headsets may be owned and operated either by independent third-party franchisees or owned by ImmerseMe and placed at local venues (e.g., specific hotels, restaurants, or hospitals) under a revenue-share or rental agreement. 
a) Hardware and Electrical Safety: Technical, structural, and electrical safety liabilities strictly concerning the internal manufacturing or technical setup of the hardware belong solely to the lawful owner and provider of the physical equipment at that specific location.
b)Venue Operational Safety and Equipment Custody: The local venue operator (the hotel, restaurant, or café where the VR station is installed) is solely responsible for the physical custody, safekeeping, and protection of the equipment on their premises, as well as maintaining a safe surrounding environment, proper sanitation practices, and supervising venue staff conduct.

You explicitly release Jasoren LLC from any operational liabilities that fall strictly under the venue operator’s local management or physical custody.

All payments for pay-per-use VR sessions are processed exclusively by third-party banks or payment service providers. ImmerseMe does not collect or store full payment card details or banking credentials. We are not responsible for errors, interruptions, or issues arising from third-party payment services, and your use of such services is subject to the terms and privacy policies of the relevant providers.

Your use of the Services is subject to our Privacy Policy, which explains how information is collected, used, and protected. By using the Services, you acknowledge that you have read and understood the Privacy Policy and agree to its terms.

All content, software, trademarks, logos, designs, videos, text, graphics, and VR experiences associated with ImmerseMe are the property of Jasoren LLC or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes only. No rights are granted except as expressly stated in these Terms.

By using the Services, you accept and assume all risks associated with virtual reality experiences. You are solely responsible for any personal injuries, health issues, or other consequences that may arise from use of the VR platform. You acknowledge that immersive VR experiences may not be suitable for individuals with certain medical conditions, including (but not limited to) heart conditions, seizure disorders, vertigo, pregnancy, or similar conditions. You explicitly acknowledge the following comfort and safety guidelines:
a) Visual Sensitivity: A small percentage of individuals may experience sensitivity to flashing lights or moving patterns in digital content. If you have a history of light-sensitive reactions, please consult a professional before use, and stop the session immediately if you feel any eye strain or changes in vision.
b) VR Adaptability and Motion Comfort: High-quality immersive experiences can feel very realistic. If the movement within the simulation feels unfamiliar or causes you to lose your sense of balance, simply close your eyes or remove the headset to return to your natural surroundings.
с) Immersive Realism: Our content features highly realistic environments, which may include simulated heights or deep water. Please choose experiences that match your personal comfort level.

If you have questions or concerns about whether VR experiences are appropriate for you, consult a qualified healthcare professional before participating.

ImmerseMe is not liable for loss, theft, or damage to the user’s personal property brought to or used at the VR station, and the user assumes all risk. If you damage or steal VR equipment owned by ImmerseMe, including headsets or accessories, you agree to pay a replacement fee of $US 800 for each stolen or damaged VR headset, $US 120 for each controller, and $US 1,000 for each broken VR station. This fee represents a reasonable pre-estimate of the cost to replace the headset and related equipment and is enforceable as part of these Terms.

You agree not to use the Services in any manner that violates applicable laws or regulations, attempt to reverse engineer or bypass security features, interfere with or disrupt the operation of the Services, or engage in fraudulent, abusive, or harmful behavior. ImmerseMe reserves the right to suspend or terminate access to the Services if these Terms are violated.

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, ImmerseMe disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or free from technical issues.

To the fullest extent permitted by applicable law, Jasoren LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid, if any, for the specific VR session giving rise to the claim.

You agree to indemnify and hold harmless Jasoren LLC, its affiliates, officers, employees, and partners from any claims, damages, losses, or expenses arising out of your misuse of the Services or violation of these Terms.

ImmerseMe may modify, suspend, or discontinue any part of the Services at any time without notice. These Terms may also be updated from time to time. Any updated version will be posted on the website with a revised effective date, and continued use of the Services constitutes acceptance of the updated Terms.

Dispute Resolution, Binding Arbitration, and Class Action Waiver.

• For Users Outside North America: These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of the UAE.
• For Users in the United States and Canada:
  • Binding Arbitration: You and ImmerseMe agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services will be settled by binding, individual arbitration, rather than in a court of law. The arbitration will be administered by the American Arbitration Association (AAA) for US users, or a recognized Canadian arbitration body for Canadian users.
  • Class Action Waiver: YOU AND IMMERSEME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims.
  • Governing Law: For North American users, these Terms shall be governed by and construed in accordance with the laws of the State of Delaware (for the US) or the Province of Ontario (for Canada), without regard to its conflict of laws principles.
